9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DC GEORGIA, ITS PASTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless DC Georgia and its pastors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to us.

Send counter-notices to admin@dcgeorgia.org.

11.2 Repeat Infringer Policy

DC Georgia has adopted a policy of terminating access for users who are found to be repeat infringers of intellectual property rights. We will disable access for any user or service provider who has infringed copyrights on multiple occasions.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.

12a. Endorsements and Testimonials

Testimonials, stories, and other user-generated content that appear on our Site represent genuine, uncompensated accounts. Any material connection between DC Georgia and a person providing a testimonial will be disclosed as required by FTC guidelines (16 C.F.R. Part 255). Typical results are not guaranteed — individual experiences with our ministry programs may vary.

12b. Nonprofit Governance and IRS Compliance

As a 501(c)(3) tax-exempt organization, DC Georgia operates in accordance with IRS regulations governing nonprofit entities. Our Form 990 is available for public inspection upon written request. 13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia, and you hereby consent to personal jurisdiction in those courts.

Before initiating any formal legal action, you agree to attempt to resolve any dispute informally by contacting DC Georgia at admin@dcgeorgia.org and allowing us 30 days to respond.

14. Religious Organization Exemptions

As a religious organization, DC Georgia operates in accordance with its sincerely held religious beliefs and doctrines. 15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
